How is a final settlement calculated in Morocco?

The final settlement (solde de tout compte) adds up everything owed to the employee on the exit date. The calculator follows Morocco's Labor Code (Law 65-99) and Decree 2-04-469:

Amounts shown are gross: CNSS and AMO contributions, then income tax, apply afterwards depending on the nature of each amount.

  • Salary due: unpaid worked days × daily rate (gross ÷ 26 working days).
  • Unused leave pay: accrued, untaken leave days × daily rate. It is owed whatever the reason for leaving, including serious misconduct.
  • Pay in lieu of notice (Art. 51): owed when the employer dismisses without having the legal notice worked, from 8 days to 3 months depending on job category and seniority.
  • Severance pay (Art. 53): from 6 months of seniority, except for serious misconduct. 96 hours of pay per year up to 5 years, 144 h for years 6 to 10, 192 h for years 11 to 15, 240 h beyond, at an hourly rate of gross ÷ 191.

How the reason for leaving changes the total

After a resignation or the end of a fixed-term contract, the settlement covers salary due, unused leave and contractual bonuses only: no severance pay is owed.

After a dismissal for serious misconduct, the employee loses notice pay and severance pay, but keeps accrued paid leave.

A wrongful dismissal can also lead to court-awarded damages (1.5 months of salary per year of seniority, capped at 36 months). These are not part of the settlement the employer issues.

Signing the final settlement receipt

The employer issues a receipt in two copies listing each amount. The employee has 60 days after signing to challenge it (Articles 73 to 76 of the Labor Code). Check every line with this calculator before signing.

Frequently asked questions

How do you calculate a final settlement in Morocco?

Add salary for unpaid worked days, pay for unused leave (daily rate = gross ÷ 26), pay in lieu of notice if the employer did not have the notice worked, and statutory severance pay if the employee is dismissed without serious misconduct after at least 6 months of seniority.

How is severance pay calculated in Morocco?

Under Article 53 of the Labor Code: 96 hours of pay per year of seniority up to 5 years, 144 hours for years 6 to 10, 192 hours for years 11 to 15, then 240 hours. The hourly rate is the average gross monthly salary divided by 191.

Does an employee who resigns get severance pay?

No. A resignation does not open the right to severance pay. The employee receives salary until the end of the notice period, unused leave pay and any bonuses set by the contract.

Is unused leave paid after a dismissal for serious misconduct?

Yes. Serious misconduct removes notice pay and severance pay, but pay for accrued unused leave remains due.

Is the final settlement subject to income tax?

Salary due and unused leave pay are taxed like salary. Statutory severance pay is income-tax exempt within the limits set by law. The calculator shows gross amounts.
